Heroes Now Forcibly Catheterizing People

South Dakota police officers are strapping people to beds and having catheters forcibly inserted into their urethras in order to extract urine from them, attorneys say.

According to attorneys for a Pierre man charged with felony drug ingestion who is asking a judge to throw out evidence in his case from an involuntary urine sample, the policy is not new. State prosecutors say the practice is legal but many disagree.

Dirk Landon Sparks said his constitutional rights were violated on March 14 following a report of a domestic disturbance. After being taken into custody, a judge signed off on a search warrant for Pierre police to obtain blood or urine after officers claimed Sparks had become “fidgety.”

When Sparks refused to comply voluntarily, attorneys say the cops transported him to Avera St. Mary’s Hospital where he was strapped to a bed while a catheter was forced into his penis so that a urine sample could be extracted.

Sparks was charged with obstruction, two counts of felony drug ingestion, and possession of marijuana and drug paraphernalia after his urine tested positive for THC and methamphetamine.

In a motion filed May 16 in Hughes County, attorneys for Sparks argued that forced catheterization was not explicitly authorized by the judge in the warrant for blood or urine, meaning that Fourth Amendment protections against unreasonable searches and seizures were violated.

A Lake Andes attorney who has represented several clients that have had urine samples forcibly taken, Tim Whalen, said healthcare workers at the Wagner and Platte hospitals routinely preform the extractions without anesthetic.

Another Lake Andes defense attorney, Pam Hein, said forced catheterization “has been going on for years,” and that she has viewed the issue from both perspectives having worked as Charles Mix County State’s Attorney and Bennett County State’s Attorney.

Hein said when an officer has suspicion of drug use, he can request a warrant for testing but the threat alone is usually enough to obtain a sample. She said only when voluntary testing is refused does force become necessary, but added that she thought the process was being abused.

The Pierre police department and the Hughes County State’s Attorney office have not offered any comment on the Sparks case or the practice for forced catheterization as a whole.

It’s not clear now often forced catheterization is being utilized in South Dakota but Attorney General Marty Jackley said the practice is permitted with a signed court order under state law. He referenced several cases that he said supported the legality of the practice.

ACLU South Dakota legal director Courtney Bowie disagreed however, and said there are definitely some serious legal concerns to consider, especially when taking into account the sex of suspects, officers, and health workers involved in an extraction.

“It would be completely improper for people to place a catheter on an individual of the opposite gender,” Bowie said. “That would border on an unlawful assault, battery or rape.”

      No “If” clause needed.
      In fact, the State already works that angle, especially with the State Pigs and the Feds. They don’t allow “locals” to police the area – a Boston-assigned State Trooper is probably from the west somewhere, and vice-versa. A Trenton (NJ) State Trooper is from Morristown. Etc.

      Why? Because if he’s local, he’ll know the land and the people, and might not actually be an abusive asshole – after all, his kid goes to the same school as Charlie’s kid, so there’s motive and opportunity on the one side, and he’s exposed… His family could be at risk.
      But if his family is 20-50 miles away? Different area, different land, different concerns, different neighbors? He’ll enforce the law more readily, more precisely, AND he’s insulated from the outcome.
      Soviet Russia did the same thing, sending Asian divisions to put down revolts in Georgia and Ukraine. “They don’t look like us,” makes them, “Them,” “The Other,” “The Outsider.”

      Makes you think, doesn’t it?
      UN police – the Africans come here to police, the whites are sent to Asia, and the Asians to Europe… Globalization of the populace, making a “One World Culture” effectively within a few generations. Allowing for interbreeding, there will be Homo Stupidus right quick… while the Elites, by contorting logic, ensure they are (like Jews) ethno-normative – but not in public! There will be Italian stars, and white stars, and Russian stars, and black stars, and , and, and (infinity). But the movers and shakers will keep to their walled estates and inner circles, and choose mates from those social circles – the “right” people, mind! And they’ll all be of a certain ethnic makeup, I’m sure (Meaning, no miscegenation, at least for a while. Can’t stop the “progress,” they just get there later in the cycle. Late enough to repeat the profit cycle a few more times.)

      Why do we put up with it? Allowing for the difficulty in finding all the movers and shakers, mind, there’s still the problem of leaving those we know of alive. “Cut off the head, and two shall grow in its place!” works great in folklore.
      But if you keep pruning, the organization gets too many heads – too many Chiefs, promoted too soon. It falls apart through entropy and mismanagement and personal goals clouding the organization’s goals.

      I don’t see it happening quickly; I also don’t see alternatives. We need to deal with the problems, and that can’t be done by voting the bums out – next set of bums is the same sort of greedy psychopath, and will perform the same tricks for the masters…
      But cull the masters, let it fall apart? Might work. Next question, “How?” Pointing at POTUS is missing the point (E.G., Trump’s VP selection – shows he’s either part of the “in crowd” now, or he’s a Trump card to quell the populace by proving “Anybody can be POTUS.” If he was an outsider still, they’d have him assassinated – UNLESS the VP was someone that would make their situation worse, say an abrasive @$$-kicker like Gunnery Sergeant Thomas Highway (film: Heartbreak Ridge). A Ted Nugent or Ron Paul would work to keep him safe. A Chris Christie or General WhateverHeIsToday (General Michael Flynn, a “Pro-Life Democrat,” a total impossibility – but a good way to steal votes from Hitlery, too.) puts a target on Trump…
      Unless he’s really batting for the other team (Which he is. I’m annoyed to learn that. But not surprised.)

      Either we band together a la Commies, or we are divided and conquered and enslaved. Individuals can’t exist in this game, doesn’t work any more. We’ll be outsiders even when inside, but we’ll be Outsiders according to TPTB regardless.
