A Preview of the Newsom Thing

Apparently, you also have a “shared responsibility” in California to pay the government for not paying the insurance mafia for the health insurance policy the federal government says you must pay for.

And California will collect what the feds say you owe, according to a reader – who says he just had his “shared responsibility” fine for not buying insurance from the mafia collected directly from his bank account.

Gavin Newsom – a far worse thing than the Biden Thing, being much younger and an active Leftist rather than a hack-tool of Leftism – shepherded a mimic law of the federal Affordable Care Act (i.e., Obamacare) that requires all Americans to pay the insurance mafia or else into law in California.

And unlike the federal law, California’s has teeth.

The feds (courtesy of Trump) no longer have the legal power to make you pay a “shared responsibility” fine if you haven’t paid the insurance mafia. If you still “owe” a “shared responsibility” fine for not having paid the mafia prior to the Trump-era repeal of the fed’s power to levy this fine ongoing (for continuing to not pay the mafia) the only method available to the feds to collect what you don’t (morally) owe is by deducting whatever they say you “owe” from your tax refund, if any. So long as you are careful to avoid paying more than you “owe” in federal taxes, the feds cannot make you pay past-due “shared responsibility” payments for not paying the insurance mafia.

But in California, there is Newsome – and here’s the thing: Fail to pay the mafia and he will make you pay the state of California, as per SB78.

The relevant portion is 61025. section (1):

(a) The Franchise Tax Board’s civil authority and procedures for purposes of compliance with notice and other due process requirements imposed by law to collect income taxes shall be applicable to the collection of the Individual Shared Responsibility Penalty.

(b) The Individual Shared Responsibility Penalty shall be paid upon notice and demand by the Franchise Tax Board, and shall be assessed and collected pursuant to Part 10.2 (commencing with Section 18401), except as follows:
(1) If an applicable individual fails to timely pay the Individual Shared Responsibility Penalty, the applicable individual shall not be subject to a criminal prosecution or penalty with respect to that failure.
(2) The Franchise Tax Board shall not file a notice of lien with respect to any real property of an applicable individual by reason of any failure to pay the Individual Shared Responsibility Penalty, or levy any real property with respect to that failure.
(3) For the purpose of collecting the Individual Shared Responsibility Penalty, Article 1 (commencing with Section 19201) of Chapter 5 of Part 10.2 shall not apply.
(c) The Franchise Tax Board shall integrate enforcement of the Individual Shared Responsibility Penalty into existing activities, protocols, and procedures, including audits, enforcement actions, and taxpayer education efforts.

The language seems to be contradictory in that “the applicable individual” – i.e., the person who did not pay the insurance mafia, per California’s law – “shall not be subject to a criminal prosecution or penalty with respect to that failure.”

And yet, my reader in California was subjected to just that. Not the criminal prosecution part (roll that around in your head a minute; a criminal prosecution – even the mention of the possibility – for failing to hand over money to the insurance mafia, a private and for-profit operation) but the payment part.

Which my reader says he was forced to pay.

He says he contacted the Franchise Tax Board and had them read the italicized portion above in an effort to get clarification. “In one ear and out the other,” he says. Per Deliverance, when the government wants your money, they’ll take your money.

And so they did.

Thus, while most Americans still enjoy the freedom to not pay a private, for-profit operation for “coverage” they don’t want and for costs they’ve not imposed on “society” (the latter being the usual justification-ululation of the Left, notwithstanding any substantiation of costs actually imposed on anyone) people who live in California have a “shared responsibility” to pay for the costs they’ve not imposed by not handing over money to the insurance mafia.

And the apparat of Gavin Newsom will collect.

“Criminal prosecutions” don’t apply – yet. Perhaps because they aren’t necessary – to collect. Apparently, the state can simply take what it says you owe – directly un-deposit style. You don’t even have to write a check.

This is a preview of what’s coming if the youthful actual Leftist should supplant the geriatric grifter who is content to be used by the Left (the pay’s quite good and so are the benefits).

Elections may not matter – but they do have consequences.

    I strongly agree they could install a youthful actor, like Gavin Newsom, because that is exactly what they want – and regardless of how the vote actually turns out. Elections are stage managed shit shows, including the polls. Which is why you should rely on the betting odds, not the polls.

    Six months ago I started predicting online, and on this site, that Gruesome Newsom (aka Jabbin’ Newscum) would be the next installed president regardless if Trump got 100% of the vote. Now I am not so sure, as a couple of weeks ago he debated Gov. Ron DeSantis and did so poorly, his Jewish wife yanked him off stage.

    Fooled again, I didn’t realize that the installed dummy Governator of Calipornia didn’t have to be charismatic in any way, any dull turd floating in the political cesspool would do so long as he pushed the agenda. How many governors are CIA installed? 100%?

    • I watched a recent PBS show on the Fall of the Roman Empire. A couple of things stuck with me, first it took a really long time. Secondly the emperors became more mad, desperate, delusional, sick, twisted, cruel, and despotic after the peak and into the decline – which surely we are there now, during the time of Caligula.

      Newscum from the porn hub of Calipornia fits the bill to a tee, although I do not think he will crucify a bunch of slaves while eating dinner, but you get the picture.

      How many Californians fled the sunshine state because of regulations and taxes? Then Covid hit, the Newscum thing locked people in their homes and said to the Los Angeles beach boys – no beach for you! It was so bad hundreds of thousands left for the snow of Idaho. Being a former surfer of SoCal and long time Idahoan, that really struck me – my god – Idaho is cold and snowy. I lived in a central Idaho mountain town, where snow sticks for 6-8 months of the year – why would anyone leave the mild climate and sun and beach?

That was our last great war we could win. Now we just flap our lips and shove money for other fools to fight our wars – which completely ruins them as well.

      If you all remember the tale of John Titor, from our future, said in 2001 Amerika would have Wacos and Ruby Ridges weekly until Russia nukes the East Coast on March 15th. We are indeed having Fed raids and staged mass shootings on a regular basis.

        I am absolutely at odds over and constantly weighing whether to move from the home/area I thought would be my home forever. I see the influx of people to what was a very rural area. I see the changes brought by these people (e.g., a local disaster called “Floydfest” that imports more than the entire population of my county into the county for a weeklong obnoxious “music festival”). And my intelligence says – move. But my heart keeps me in denial. And – where to move? Where – within this country – can one go that is safe from these people? I have no good answer…

          When it is our time, it is our time. I have decided I am not going to move. I live in an area where there is an abundance of local farms, clean water, good neighbors, no extreme weather, and pretty views. Insurance and property costs aren’t ridiculous either…at least not yet.

          There is no escape from growth or the resettlement of people. All you can do is build yourself a haven somewhere and make that your bubble.

          I was hung ho on transporting the familia and I to someplace a bit saner, until I determined there is no such place. I am sticking with the topography I know. It is never a bad idea to have a second location, but it should be viewed as an investment or a second retreat. It should also be easy to get to. If you are sitting on at least 5 acres of land that is usually enough space to ignore the commotion around you. 😊

          Where to move? Well, you can’t really move. You are tied to an EV charger. As an automotive journalist who now will continually have the ubiquitous EV reviews to perform, you cannot be too far from an EV charger. You will have to remain in range of the lowest range EVs on the market. You are already captured in the EV system by sake of your profession.

    • A crazy driver passed me on a city street more than 40 mph, ran a stop sign, darn near hit another car at the intersection, continued to speed on to a location another half a mile away. I called the cops, followed the vehicle to the location where the driver stopped for whatever reason at a residence. You’re a nut at that point, probably drug related.

      You can’t be driving like a madman anywhere you go. Somebody could get hurt if you cause an accident. Come on, drive like the ordinary people do.

  5. The real hell of it is that catastrophic health insurance is actually in the spirit of what health insurance should be—coverage for big, random, unexpected events.

    I remember my grandmother referring to her health insurance as “hospitalization insurance.” It wasn’t all that expensive—I think the premiums worked out to about $1.50 a day. But as the name implies, it was to cover you if you were in the hospital. You paid for everything else yourself. And it paid for you to be in a “semi private” room at the most.

    Perhaps we wouldn’t be having the whole debate if this were still around…

    • While visiting my father-in-law at a nursing home/hospice facility, a female patient/resident in another room there was expressing vocally her libido feelings.

      She was suffering from severe dementia.

      I would buy a catastrophic policy – with a very high deductible – if such were available. Because that’s all I need. I have no dependents and if I croak, Dawn is taken care of. But it’s be worth a couple hundred bucks annually, say, to buy coverage for an extreme/unlikely emergency event such as a chainsaw accident or heart attack, etc.

      Otherwise, I’ll roll with the punches!

      • The thing that most people are concerned about isn’t paying $25 for a prescription, or even $250 for an office visit and lab tests—it’s $25,000 or even $250,000 for an operation and hospital stay. And the bulk of that is during the last year of your life.

          I know I am saying this from the vantage point of relative youth and health, but: I’m not living my life in fear of what if and paying for just-in-case. In fact, were it not for all this being forced to pay for what if (and assuming people saved what they weren’t forced to spend) most people could afford to pay for the care they might need at the end of their lives.

          • Well I’m NOT at a vantage point of relative youth and health, 69 with Rheumatoid arthritis, but I’ve still quit the game. No one gets out of this alive. I was offered treatment in the form of biologics, that could be had for the “bargain” price of 60k per year. I refused. The doctor said I could get funding for it. I told her I would not be a party to such extortion, regardless how well it worked. And fired her. I quit eating sugar, and take a number of supplements. My condition has slightly worsened over the last 3 years, but I’m old, and getting older, so I’m not surprised. Such is life, and death.

            • Rheumatoid is a nasty one. Autoimmune. Quitting sugar is the best, maybe an all meat diet, zero carbs at all. My aunt had it, boy its rough.

  6. Just an FYI when it comes to the health insurance mandates by state.

    There are currently six states that impose a penalty or “shared responsibility” for not having a health insurance plan: CA, DC, MA, NJ, RI, and VT. Some of them are based on a fixed fee per taxpayer/dependent others base it off your adjusted gross income…the higher the income, the higher the penalty.

    These penalties are built into the total tax on your state return and are treated as unpaid taxes which the state will easily levy against your checking or savings account if left unsettled.

    Expect this to become more popular as the years roll because Uncle Sam’s little brother is always looking at new ways to separate the state’s residents and their wallets.

    • I believe WA State now mandates some kind of catastrophic care policy for residents. Governor Kirkland signed it into law and there was a grace period, but that grace period may have expired if it was not extended again.

        I believe that most (if not all) of the catastrophic insurance agents pulled out of the state by 2022. I am not aware of any penalties associated for not having it though. I would not be surprised if they look at bringing it back sometime in the future.

      • Unfortunately, Eric, there is only about a handful of countries where you can truly “own” land…Cayman, T&C, Dominica, Malta, Monaco, Croatia, and the UAE….there may be a few more, but I think they can only be counted on two hands. They also pretty expensive to get into. Although, a $100K investment will get you a second passport to Dominica…something to consider. They also have a French bakery on the island to boot. 🙂

  8. Direct withdrawal from your bank account by the government in CA has been happening for quite a while. About 13 years ago a friend of mine had an old motorcycle (76 Yamaha 750) he stopped riding parked in his side yard. He had been receiving letters of overdue registration but ignored them since he was not riding the bike. Then he noticed his bank account had been tapped by the state of Marxism for the overdue registration. I asked him how they could do that, he said he paid his taxes direct by check, so they had his bank routing number and I guess his bank was more than willing to comply.

    • Hi Hans,

      California would have needed to serve his bank with a lien first. Also, if he had direct deposit of a refund in the past most states (and the IRS) will hold onto this information, which makes getting the lien that much easier because they know who to serve.

      I always advise clients to setup a subaccount that is not directly tied to your main operating account. Nothing should ever be directly debited or deposited into the main account. Keep the subaccount at the same bank and make transfers back and forth when needed. The subaccount should hold about $100 tops (although I usually keep around $5 in mine).

      • Don’t keep the main account in a “too big to fail” bank with a presence in the State of California and subject to the state’s laws.

        I keep our main accounts in credit unions chartered to operate only in Texas ever since we lived in WA State where I suspect the “too big to fail” bank provided my wife’s employer, the largest private payroll in the county and the bank’s biggest customer in SW WA State, with our balance information on a regular basis.

        EBay and Paypal go through the credit union account I maintain in WA State and subject to 9th Circuit rulings. Credit card companies never get any routing/account numbers. I don’t have any “modern” e-payment accounts like Zelle, Venmo, or Apple Pay.

  15. Just looking at the way Gavin Newsom ruled California during COVID hysteria gives one an idea of what he’ll be like if he should one day become President. He’d likely be the American version of Canada’s Prime Minister, Justin Trudeau, who ruled as a tyrant himself the past few years. Remember him freezing the bank accounts of Canadian truckers who protested his draconian COVID jab mandates and that of people who supported the truckers? Newsom would undoubtedly LOVE to be an American Justin Trudeau, though he insists he’s not running for President. We shall see.

  19. The whole notion of Nation/States post Treaties of Westphalia 1648 needs to go into the ashbin of history. It has institutionalized the idea of predatory overlords that have no interest in the wellbeing of the people that live in a given area. It basically said the entire planet is to be subdivided into various “governments”. No area is exempt.

    An interesting case in point is happening right now. After the fall of the Ottoman Empire the Brits took over the area called Palestine. When the Brits were driven out the U.N. said that Jews had title to the land despite it being occupied by clans that had been there for centuries. However, those clans were without Government so the U.N. imposed on and European Jews happily filled the role.

    The idea of not having government is simply not allowed since 1648. It will take an immense sea change in thinking to reverse course. I doubt we’ll see it in our lifetimes. However, I never thought the Soviet Union would fall without a shot being fired so there may be hope after all.

    When I was running a business, the State of Taxachusetts (where I had NO business presence) dunned me for sales tax on goods I imported through the port of Boston. Since their claim had no legal basis, I ignored it. They proceeded to levy the money — a four-figure sum — from my JPMorgan Chase business account.

    The law says that a state government other than one’s own state of residence is obliged to go to court to collect an alleged debt. But practically speaking, regional and national banks are their supine handmaidens. They don’t need no stinkin’ laws.

    A purely intrastate bank such as a local credit union might not have complied so readily with a levy order from out of state. A California resident wanting at least one thin defense against Newsom’s red-guard looting would need an out-of-state account in a bank that has no branches in Commiefornia.

  21. Direct deposit is evil. The only thing banks care about is that you have a continuing direct deposit account – preferably with govt money refueling it. That is the holy grail of society – a direct deposit account with government money (SS, SSI, welfare). It’s a money spigot that never turns off. You peons who deposit private money can easily stop depositing and then what will banks do? That’s why banks require direct deposits for checking accounts and will make you pay more fees if you don’t have DD. Direct deposits are the forerunner of CBDC.

    I’ve had to re-read Richard Hoskin’s “War Cycles, Peace Cycles” to get a grip on how it’s playing out, but it all becomes clear when you realize that as white, middle-class America ages, shrinks (i.e. fertility is below replacement rates) and becomes more heavily indebted, banks have fewer prospects for lending more money into circulation. It explains why the 2020 scamdemic was needed as a catalyst to force into play the new long-term usury cycle.

    It also explains why massive immigration is being encouraged (to introduce new potential debtors who enter the economy with a clean slate), why the old guard, i.e. whites, are being squeezed into oblivion (their lending potential is diminishing), why taxes are increasing (to remove excess money from circulation and facilitate lending) and why wars are breaking out everywhere (it helps facilitate even more new loans).

    I just asked Bing AI to break down the average debt of white, black and Hispanic Americans. Turns out the average white household has about $150,000 in debt, blacks $98,000 and Hispanics just $37,000. The latter statistic explains why our southern border is being inundated (massive lending potential) and why blacks–who mainly use cash–are being pandered to on virtually every TV commercial (to prepare them for enhanced credit lending, as they currently have the lowest credit card balance/use of all races).

    Without the steps being taken by the powers-that-be right now, the usury system would almost assuredly collapse. Of course there are lots of moving parts here, but when you examine it from the perspective of “follow the money trail” it all makes sense.
